1. Acceptance of Terms

By accessing or using Linkvor ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 16 years of age to use the Service. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide a valid email address and verify it to access all features.
  • You must not create multiple accounts to circumvent tier limits or abuse the Service.
  • You must notify us immediately if you suspect unauthorized access to your account.

4. Subscription Tiers & Pricing

Linkvor offers multiple service tiers (e.g., Free, Pro) with different feature sets and usage limits. You acknowledge and agree that:

  • Tier limits may change: The number of links, products, QR codes, and other resources available on any tier may be increased, decreased, or restructured at any time at our sole discretion.
  • Free tier availability: The Free tier is provided as a courtesy and may be modified, limited, or discontinued at any time without prior notice. We are under no obligation to offer a free tier indefinitely.
  • Pricing changes: Prices for paid tiers may change. We will provide at least 30 days' notice before price increases take effect for existing subscribers.
  • Feature availability: Features may be added, modified, moved between tiers, or removed. We will make reasonable efforts to notify users of significant changes.
  • No grandfathering guarantee: Unless explicitly stated in writing, existing users are not guaranteed continued access to deprecated features or tier structures.

5. Early Bird & Promotional Offers

From time to time, we may offer promotional access (such as "Early Bird Pro") with enhanced features at reduced or no cost. You acknowledge that:

  • Promotional offers are made at our sole discretion and may be revoked if you violate these Terms.
  • We reserve the right to modify the scope, duration, or benefits of any promotional offer at any time.
  • "Lifetime" or "forever" promotional access means for the lifetime of the Service, not unconditionally. It remains subject to these Terms and continued operation of the platform.
  • Promotional access may be terminated if your account is inactive for more than 12 consecutive months.
  • Promotional offers are non-transferable and tied to a single account.

6. Acceptable Use

You agree NOT to use the Service to:

  • Create links to illegal, harmful, fraudulent, or malicious content
  • Distribute malware, phishing pages, or deceptive redirects
  • Infringe on intellectual property rights of others
  • Engage in spam, misleading advertising, or deceptive practices
  • Violate applicable laws including FTC disclosure requirements for affiliate marketing
  • Circumvent rate limits, usage restrictions, or security measures
  • Use automated bots or scripts to create links or inflate analytics
  • Host adult content, hate speech, or content promoting violence
  • Impersonate others or misrepresent your affiliation with any person or entity

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines without prior notice.

7. Content Ownership & License

Your Content

You retain ownership of all content you create on Linkvor (products, links, images, descriptions). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely for the purpose of operating and providing the Service (e.g., displaying your public storefront).

Our Content

The Linkvor platform, including its design, code, branding, and documentation, is our intellectual property. You may not copy, modify, or redistribute any part of the Service without written permission.

8. Third-Party Links & Destinations

Linkvor enables you to create links that redirect to third-party websites. You acknowledge that:

  • You are solely responsible for the destination URLs you configure.
  • We are not responsible for the content, availability, or practices of linked third-party websites.
  • You must ensure your affiliate links comply with the terms of the affiliate programs you participate in.
  • You are responsible for proper FTC disclosures when using affiliate links.
  • We may disable links that point to malicious, illegal, or harmful destinations.

9. Analytics & Data Accuracy

We provide analytics (clicks, scans, geographic data, device information) on a best-effort basis. You acknowledge that:

  • Analytics data may not be 100% accurate due to factors like VPNs, ad blockers, bot traffic, and caching.
  • Geographic and device data is derived from IP addresses and user-agent strings, which may be imprecise.
  • We do not guarantee real-time accuracy of analytics dashboards.
  • Analytics data should not be the sole basis for critical business decisions.

10. Service Availability & Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

  • We do not guarantee uninterrupted, error-free, or secure operation of the Service.
  • We may perform maintenance, updates, or changes that temporarily affect availability.
  • We are not liable for any loss of revenue, traffic, or data resulting from Service downtime.
  • Link health monitoring is provided as a convenience and does not guarantee detection of all broken links.

11. Limitation of Liability

To the maximum extent permitted by law, Linkvor and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue from broken or disabled links
  • Loss of affiliate commissions due to link downtime
  • Inaccurate analytics data leading to business decisions
  • Data loss or security breaches beyond our reasonable control
  • Actions taken by third-party services (payment processors, hosting providers)

In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

12. Termination

  • You may terminate your account at any time by contacting us.
  • We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
  • Upon termination, your public storefront and links will be deactivated immediately.
  • We may retain certain data as required by law or for legitimate business purposes (see our Privacy Policy).
  • Sections regarding limitation of liability, intellectual property, and indemnification survive termination.

13. Indemnification

You agree to indemnify and hold harmless Linkvor, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
